Tubewell Registration/ NOC Mandatory in Haryana
New Major Compliance and Inspection notified in Haryana related to the use of Ground Water and Borewells
As you know, The Haryana Water Resources (Conservation, Regulation, and Management) Authority has made the Registration of the Tubewells/ borewells mandatory for all (including MSMEs) using groundwater within specified limits.
Large units and those using more than prescribed limits of groundwater, need NOC also from HGWA.
The last date to apply for Registration/ NOC was 28th February without the late fee.
HRWA has now notified that the following Officers from three departments are authorized to do Inspections of Industries for regulating the use of Ground Water and check unauthorized Tubewells/ borewells.
For Faridabad & Gurugram
A) The officer of the Department of Irrigation & Water Resources (Executive Engineer)
B) Officer of Town and Country Planning (Not below the rank of District Town Planner)
C) Officer of Haryana State Pollution Control Board (Not below the rank of Regional Officer).
The above Officers have been empowered as Enquiry officer/ Enforcement officer/Compliance Officer
The functions of the officers shall be:
i) discovery & production of documents
ii) summoning and enforcing the attendance of any person
iii) to conduct field inspection
iv) enter into any premises for inspection and inquiry
v) submit report/ interim report to the Haryana Ground Water Authority (HGWA)
Environmental Compensation:
“Abstraction of groundwater for commercial use by industries, infrastructure units, and mining projects, without a valid No Objection Certificate shall be considered illegal and such entities shall be liable to pay Environmental Compensation for the quantum of groundwater so abstracted.”
The norms prescribed by Central Pollution Control Board (CPCB) shall be utilized for calculating the Environmental compensation. Minimum Environmental Compensation shall be Rs.1.0 lakh or more.
1. Keep a copy of Registration/ NOC with Security Guards and also display it near Tubewell to show to the Inspecting Authorities when they surprise you with their Inspections
2. Install a water meter to prove qty of Groundwater extracted. This shall help calculate the exact compensation amount in case non-compliance is detected
We caution all members to ensure Registration of the Tubewells/ borewells (It is mandatory for all including MSMEs) using groundwater within specified limits. Other units and those using more than prescribed limits of groundwater, need NOC also from HGWA.
We organized special camps in the last 6 months and helped our members register their tubewells and organized NOCs for those who required. We hope all our member units in the region are now compliant and that there is no unauthorized (unregistered/ without NOC) tubewell in the units. If any unit has been left without Registration/ NOC, please immediately apply.
